1. 12-month minimum term

All Swerve subscription plans have an initial minimum term of 12 months from the agreed service start date, unless we expressly agree otherwise in writing before the service starts.

The monthly subscription remains payable throughout the initial minimum term, including if you decide that you no longer wish to use the service before that term ends, except where the law gives you a right to cancel or we agree otherwise in writing.

2. Cancellation after the minimum term

After the initial 12-month minimum term, the subscription continues on a monthly rolling basis until cancelled by either party on one month's written notice.

You may give cancellation notice during the final month of the initial term so that the subscription ends no earlier than the end of the 12-month minimum period. This avoids requiring an additional month solely because notice was given before the anniversary date.

Cancellation requests should be sent to contact@swerve.co.uk. We will confirm the effective cancellation date in writing.

3. Payments and missed payments

Subscription payments are due on the agreed billing date. If a payment remains unpaid for five working days after its due date, we may suspend the website and/or managed email services, maintenance, support and other subscription services until the overdue amount has been paid.

Suspension for non-payment does not itself cancel the subscription, remove outstanding charges or end the minimum contractual term. We will normally restore services as soon as reasonably practicable after cleared payment is received.

4. Website, hosting and email availability

Swerve uses external hosting, domain, DNS, email and other infrastructure providers. Their systems are outside our direct control. Although we will use reasonable efforts to select suitable providers and assist with faults, we cannot guarantee uninterrupted or error-free website, hosting, DNS or email availability.

We are not responsible for outages, delays or failures caused by third-party infrastructure, internet or network failures, scheduled or emergency maintenance, domain/DNS issues, cyber incidents affecting suppliers, or other events outside our reasonable control. Where appropriate, we will use reasonable efforts to liaise with the relevant provider and help restore service.

5. What happens when a subscription ends

Any services that depend on the active Swerve subscription, including managed hosting, maintenance, support and managed email arrangements, may stop at the end of the paid service period unless alternative arrangements are agreed in writing.

Domains, website files, content, third-party licences, email data and other assets may have different ownership or transfer arrangements depending on the project. Those arrangements should be confirmed in the project proposal or customer agreement. Any unpaid amounts remain due after cancellation.

6. Changes to a plan

If you request work or capacity outside the allowance of your plan, we may agree an upgrade, additional fee or separate scope before carrying out the extra work. We will not treat material additional work as included merely because a subscription is active.

7. Fair use and customer responsibilities

Included updates and support are intended for reasonable business use within the limits described on the pricing page or in your proposal. You are responsible for providing accurate content, approvals, access credentials and other information reasonably needed to deliver the service.

8. Statutory rights

Nothing in this policy excludes or restricts rights or remedies that cannot lawfully be excluded. If a separate signed proposal, order form or service agreement contains specific terms that conflict with this page, the specifically agreed written terms will take priority to the extent permitted by law.
